Toyo Seikan Group’s Social Media Terms of Use

1.These terms of use apply to all users of the Service (“Users”).

2.All Users are prohibited from engaging in the acts described below when using the Service. The Group reserves the right to remove any content posted on the Service without prior notice and take any other required measures if it determines that the content includes any information of these acts in which any Users have engaged or may engage.

• Criminal acts or any acts that violate laws and regulations or public order and morals.
• Political activities, election campaigning, or religious activities.
• Posting any inappropriate content that falls in any of the following (including similar content):
  
  • Content that includes obscene expressions;
  • Content that includes discriminatory expressions;
  • Comments intended to commit criminal offense or that encourage others to commit criminal offense;
  • Comments that defame specific individuals, organizations, or countries or regions;
  • Content that is not acceptable from an ethical perspective;
  • Content that is offensive to any other Users;
  • Content that is unrelated to the purpose of the Service;
  • Content that has been created by a User with false online identities to pretend that it is created by multiple Users on the Service;
  • Content that discloses private communication between Users and the Group or a third party;
  • Content that includes false or misleading information;
  • Content that includes any personally identifiable information and that discloses any personal information without the consent of the relevant individual; or
  • Comments for any commercial purposes of Users, including the promotion and advertisement of their own products, services, stores and organizations.
• Impersonation of a third party, including the Group.
• Duplication, sale, publication or any other use of information provided on the Service for any purpose other than personal use.
• Acts that infringe or may infringe on copyrights, trademarks, portrait rights, privacy rights or any other rights of other Users, third parties or the Group.
• Spamming.
• Posting or transmitting information containing harmful computer programs.
• Acts that interfere or may interfere with the management of the Service.
•   Acts that violate the terms of use for the Service.
•   Any other acts that the Group determines to be inappropriate.

3.Disclaimers and other important information

• The Group shall not be liable for any damage, trouble or disadvantage whatsoever incurred by any Users on the Service in connection with any information appearing on the Service and any changes or updates to such information.
• The Group shall not be liable for any damage, trouble or disadvantage whatsoever incurred by any Users as a result of the use or inability to use of the Service.
• If any conflict or dispute arises between a User and any other Users or third parties in connection with the use of the Service, such problem shall be resolved at the sole responsibility and expense of such User without causing inconvenience or damage to the Group.
• The Group shall assume no liability for any content posted on the Service by any Users.
• The Group shall not guarantee the accuracy or completeness of the information contained in any content posted on the Service.
• If the Group suffers any damage arising from any acts of Users pertaining to the Service, it may claim compensation for such damage from the relevant Users.
• All copyrights and other intellectual property rights (including, but not limited to, design rights, patent rights, utility model rights, trademarks and know-how) (collectively, "Copyrights") of the information appearing on the Service or the right to use such information belong to the Group or their respective owners (such as author of the information). All Users may use the information provided on the Service with the permission of the relevant owners of Copyrights and in a legally compliant manner, such as private duplication permitted under the copyright law. Any use of such information for commercial purposes is strictly prohibited.
• All Users retain Copyrights on the content they posted, but by posting such content on the Service, the Users grant the Group a non-exclusive, worldwide, royalty-free right to use (e.g. process, excerpt, duplicate, publicly display and translate) the content and agree not to assert any moral rights against the Group.
• The Group reserves the right to change these terms of use at any time without prior consent of any Users.

4.These terms of use are governed by the laws of Japan. Any dispute between Users and the Group shall be subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
